Mediation is a form of out-of-court dispute resolution.
As part of a mediation process, a neutral, impartial mediator supports and promotes communication between the parties, systematically and using recognized methods, in order to enable a solution that is satisfactory for all parties. The mediator is free from prejudice and judgment towards the parties. The result is a harmonious, future-oriented, self-developed and self-responsible conflict solution.
Mediation can be a cost-minimizing and time-saving alternative to due process of law. By resolving the conflict and the points of contention, the parties save themselves an often lengthy and burdensome process in court. The risk of losing a court case and the associated costs (court fees, legal fees of the opposing party, your own legal fees) is replaced by an often expeditious procedure. The aim is to agree on a win-win solution that does not lead to a loss of face on either side and to the satisfaction of their own needs.
The parties have the advantage of being able to control the process and the final outcome of the mediation process themselves, as opposed to court proceedings. Only when all parties agree with the result is the process successfully completed.
Through our trained or registered mediators, we guide you in the mediation process to an amicable and sustainable solution.
Mediation can be used in a wide variety of conflict situations, both in private and professional areas.
Disputes between companies often lead to situations in which a future economic relationship no longer seems possible. We help you to find a consensus for your point of contention, whereby entrepreneurial cooperation remains possible and neither of the two is economically disadvantaged. Even in the event of disputes within a company, we support you and your employees in finding a common and lasting solution without endangering the working atmosphere.
Conflicts within the family are often very emotional and burdened by the past. We help you to find a solution to your conflict in a careful, emphatic and goal-oriented manner and strive for a promising and harmonious basis for discussion in the future. We support disputes in matters such as custody, alimony, right of contact, household, division of assets and inheritance. Using recognized methods, we control the communication between the parties in such a way that a lasting result is achieved and the family structure is not endangered, but can even be strengthened.
In the event of neighborhood conflicts due to the deprivation of light or air by other people's trees or plants, an amicable settlement must be attempted before a lawsuit is filed. If both neighbors agree, this can be done through mediation (Art III ZivRÄG 2004). We offer you the opportunity to find a jointly developed solution for your conflict within a mediation, with which all parties can live happily and the neighborly relationship is not damaged or even improved.
When planning environmentally relevant projects (e.g. construction projects for operating facilities, roads, railway and air routes, transmission masts), there are often hardened fronts among those involved or affected. In the past, a mediation process has often proven to be expedient here. In mediation, we make sure that all parties are given sufficient attention and that a future-oriented and sustainable solution is found.
Due to our specialist knowledge, we can also answer general legal questions for the parties in a mediation process and thus strive for optimal solutions for all parties involved.
