Insolvency law regulates the procedure that is used when a company or a private individual is overindebted and there is no positive forecast for continued existence or becomes insolvent. The court usually appoints an insolvency practitioner who manages the debtor's assets and attempts to either continue or liquidate and distribute the proceeds to creditors.

We support both debtors and creditors in enforcing their claims before, during and after insolvency proceedings (bankruptcy or restructuring proceedings). Together we develop economically effective restructuring plans. Among other things, Prof. Kindel also works in Austria as an insolvency administrator.

Credit law covers the legal framework for the granting of credit. We advise you on all questions relating to credit law, which prescribes comprehensive information for lenders. They must provide information about the terms of the loan. Violations of this information obligation will result in the credit agreement being partially ineffective or the consumer being entitled to compensation.

Another issue is credit protection. The lender protects himself by pledging the borrower's assets or by guaranteeing third parties. We check the contractual leeway in terms of collateral.

Borrowers also receive help from us in checking for illegal clauses in loan agreements and in enforcing reclaims of unjustified fees and interest.
